I didn't realize that the "Rarities" auction had ended but it should have been pulled by ebay, same as the Slim's show and the Hammerstein show. I wonder why they didn't pull them. They're usually pretty good about taking care of it once they're reported.
Sorry everyone! Somehow I did not get to that listing from the item number provided. Anyway, I think this is fine to sell, and would not report it. The official eBay policy on radio promo items is a bit hazy, but I personally own lots of promo versions of singles that I bought on eBay, and they have been officially released at least to the radio stations. I think the key auctions to report are those where people are simply burning copies of audience recordings to make a profit, rather than re-selling an original copy of a released CD, even if only promotionally released.
As for this particular concert, according to Simon's spreadsheet, this is from the show of Aug. 19, 1994, at St. Dennis Theater in Montreal. Simon also has this radio show listed, albeit with the date of June 19, 1995. The CD itself says "The Week of January 16, 1995," but who's to say when it actually aired or when it was recorded by his source.
